These Terms of Use ("Agreement") govern your access to and use of Bikudo ("we," "us," or "our"), a global business directory available at bikudo.com ("Site"). By accessing or using the Site, you agree to be bound by this Agreement. If you do not agree, do not use the Site.
1. Description of Service
Bikudo is an online business directory that allows companies to list their profiles and product catalogs, and allows visitors to browse and contact those companies. We are a directory only. We do not participate in, facilitate, or mediate any transaction, negotiation, or agreement between users. All business dealings are exclusively between the buyer and the listed company.
2. Eligibility
You must be at least 18 years old to create an account or submit any content to the Site. By using the Site, you represent that you meet this requirement and are legally capable of entering into a binding agreement. The Site is intended for business use. It is not directed at children under the age of 13, and we do not knowingly collect information from children.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@bikudo.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate this Agreement.
4. Listing Content
By submitting a company profile, product listing, or any other content ("Content") to the Site, you represent that:
- You are authorized to submit the Content on behalf of the company.
- The Content is accurate, not misleading, and does not infringe any third-party rights.
- The Content does not contain unlawful, harmful, defamatory, obscene, or fraudulent material.
You grant Bikudo a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your Content on the Site for the purpose of operating the directory.
5. Prohibited Conduct
You agree not to:
- Submit false, misleading, or fraudulent company or product information.
- Use the Site to send unsolicited commercial messages (spam).
- Attempt to gain unauthorized access to the Site or other users' accounts.
- Scrape, crawl, or otherwise extract data from the Site without our written consent.
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
- Interfere with the performance or integrity of the Site.
6. No Endorsement
Bikudo does not endorse, verify, or vouch for any company, product, or service listed on the Site. We make no representations regarding the reliability, accuracy, or quality of any listed company. Users are solely responsible for conducting their own due diligence before entering into any business relationship.
7. Intellectual Property
All Site design, code, trademarks, and non-user-submitted content are the exclusive property of Bikudo. You may not copy, reproduce, or distribute any part of the Site without prior written permission. The Bikudo name and logo are trademarks of Bikudo and may not be used without consent.
8. Third-Party Links and Advertising
The Site may contain links to third-party websites and display advertisements served by third-party networks including Google AdSense. Bikudo has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites. The presence of an advertisement does not constitute endorsement of the advertised product or service.
9. Disclaimer of Warranties
THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIKUDO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY CONTENT LISTED THEREON, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. Indemnification
You agree to defend, indemnify, and hold harmless Bikudo and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Site, your Content, or your violation of this Agreement.
12. Modification and Termination
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We may suspend or terminate your access to the Site at any time, with or without cause, without liability.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in the United States.
